State v. Montgomery

Synopsis: Montgomery was convicted of possession of pseudo ephedrine with intent to manufacture methamphetamine. Did a jury instruction on missing witnesses or opinion testimony on his intent deprive him of a fair trial and should the court have considered imposing an unrequested first time offender sentencing waiver?

State v. King

Facts:

Petitioner Tyler King was prosecuted for reckless driving on a motorcycle after being arrested and issued a criminal citation by a police officer outside of the officer’s territorial jurisdiction.  King moved to dismiss the charge in Clark County District Court, arguing the officer arrested him outside his department’s boundaries without a valid interlocal agreement allowing him to do so.  Read more…

Synopsis: Whether, pursuant to Fry v. United States, 293 F. 1013 (D.C. Cir. 1923), the trial court in a personal injury action properly excluded expert testimony that exposure to organic solvents during pregnancy can cause neuronal birth defects.
