Washington v. Kilgore

Docket No. 81020-6 (from Court of Appeals Division II Case No. 34053-4)  Facts: Petitioner Mark Kilgore was convicted of three counts of rape of a child and four counts of child molestation, and the trial court imposed an exceptional sentence of 560 months for each count to be served concurrently. Two counts were reversed on appeal, the remaining counts were affirmed, and the case was remanded for retrial but the state elected not to retry the two reversed counts. Continue reading

Noble v. Safe Harbor Family Preservation Trust

Docket No. 80873-2 (from Court of Appeals Division II Case No. 35227-3)  Facts: Respondent Fred Noble and wife filed a petition to condemn a way of private necessity across petitioner landowner Safe Harbor Family Preservation Trust’s property to gain access to the Noble’s property. Safe Harbor (condemnee) alleged that the Noble had a feasible, alternative route. Respondent Tillicum Beach Inc was later added by the Noble as an alternative condemnee. Continue reading
