Docket No. 79767-6  Facts: Petitioner Desmond Modica was convicted of assault, resisting arrest, and witness tampering in the Superior Court for King County after striking his wife and subsequently attempting to prevent his wife from testifying via phone calls made to his grandmother while he was in jail awaiting trial. Modica appealed his conviction for witness tampering, asserting that the phone calls to his grandmother were private and had been recorded and used as evidence against him in violation of the Washington Privacy Act (Washington Revised Code §9.73.030).
