Docket No. 79262-3  Facts: Petitioner Dale Schwab was convicted of first degree manslaughter and second degree felony murder in the Superior Court for Snohomish County after killing a man in an altercation. Upon appeal, the Washington Court of Appeals vacated Schwab’s conviction for first degree manslaughter, ruling that convictions for both first degree manslaughter and second degree murder for a single homicide violate the 5^th Amendment to the United States Constitution’s prohibition against double jeopardy.
